Terms of Use

These Terms of Use ("Agreement") have been established between the operator of the FoundrOne platform and the person who registers on the platform or uses it.

FoundrOne is currently not operated under a company legal entity. The data controller and operator of the platform is the individual operator of FoundrOne.

1. Subject of the Agreement

This Agreement regulates the terms of use of FoundrOne, the rights and obligations of users, the content rules and the operating principles of the platform.

2. Membership

Users may need to create a membership in order to use FoundrOne. Membership can be completed

  • with email and password
  • with a Google account

and the user accepts that the information they provide is correct and up to date.

3. Acceptance of the Agreement

The user must accept this Agreement before creating an account. The date of acceptance of the Agreement and the accepted version of the Agreement may be recorded in the system.

4. Account Security

The user is responsible for the security of their account. They must not share their password with third parties. If they believe their account has been accessed without authorization, they must notify support@foundr.one.

5. Username

The user may choose any appropriate username. However, the username may not be used

  • to impersonate another person,
  • to commit forgery,
  • to carry out fraud,
  • to impersonate the identity of another person or organization

for those purposes.

6. Profile

The user can create their own profile and upload a profile photo. The user may not share personal data belonging to others or unlawful content on their profile.

7. User Content

Users can create on the platform;

  • posts,
  • comments,
  • upvotes,
  • startups/products,
  • Build Push,
  • images,
  • links,
  • descriptions

and the user is responsible for the content they create being lawful.

8. Visibility of Content

User content on FoundrOne is currently only viewable by registered and logged-in users.

9. Editing and Deleting Content

Users can edit or delete their own content. The administrators of FoundrOne may remove content in case of a violation of this Agreement or the Community Rules.

10. Ownership of User Content

The intellectual property rights of the content created by the user remain with the user, unless otherwise valid under law.

By uploading content to the platform, the user grants FoundrOne a limited license, to the extent necessary for the platform to operate, including the rights to

  • host,
  • store,
  • reproduce,
  • technically process,
  • display to users

so that it can provide the services of the platform. This license does not mean that the intellectual property rights belonging to the user are transferred to FoundrOne.

11. Promotional Use

User content may be displayed on the platform's landing page, on social media accounts or in similar promotional areas in order to promote the community or the platform of FoundrOne. This use does not mean that the ownership of the user content passes to FoundrOne. FoundrOne takes care not to use content out of context or in a way that would mislead the user.

12. Copyright

The user accepts that they have the necessary rights over the content they upload, or that they have the necessary permission to share it. Sharing someone else's content without permission as if it were their own is prohibited. Copyright infringement notices may be examined, and content may be removed if an infringement is found.

13. Startups and Products

Users can publish their own products or startups on the platform. Product information is provided by the user. FoundrOne does not guarantee

  • that the product really belongs to the interested user,
  • that the given information is correct,
  • that the product is operating,
  • that the revenue or user count is correct

There is no active startup ownership verification system.

14. Financial and Investment Content

Users can share that they are looking for investment or investment opportunities on the platform. FoundrOne does not provide

  • investment consultancy,
  • financial consultancy,
  • investment advice,
  • investment guarantees,
  • revenue guarantees

FoundrOne is not responsible for the investment, trade or similar relations that users carry out among themselves. No money transfers are currently made over FoundrOne.

15. Trade Secrets

Users may share source code, trade secrets, product strategy or confidential information on Build Push or in other areas. The risk that may arise from such information being voluntarily shared by the user belongs to the user. Users are advised to protect their trade secrets and confidential information before sharing.

16. Advertising

A user may promote their own registered product or startup in accordance with the platform rules. Advertising other products without permission, sharing spam advertising, or using the platform as an advertising distribution network is prohibited.

17. Reporting and Moderation

Users may report content they deem appropriate. Reports may be reviewed manually. FoundrOne does not necessarily accept that reported content constitutes a violation; it acts according to the result of the evaluation.

18. Account Restriction and Closure

FoundrOne may restrict or close an account temporarily or permanently in order to protect user safety and community order. In particular, an account may be closed in cases such as

  • fraud,
  • forgery,
  • identity theft,
  • harassment,
  • threats,
  • serious or repeated misuse,
  • personal data breaches,
  • copyright infringement,
  • phishing,
  • malware,
  • harmful code,
  • fake investment promises,
  • pornographic content,
  • illegal activities,
  • hate speech,
  • spam,
  • community manipulation

In serious cases, action may be taken without prior warning.

19. Account Deletion

To delete a user account, a request can be sent to destek@foundr.one or kvkk@foundr.one. During the account deletion process, the necessary information may be requested for identity verification. The scope of the deletion is determined by taking into account legal retention obligations and the technical requirements of the platform.

20. Deleted Account

When an account is deleted, some content previously published by the user may be shown under an anonymized user such as "deleted account" in order to preserve the integrity of the platform. It is aimed to separate this content from the account information that directly identifies the person.

21. Responsibility of the Platform

FoundrOne does not guarantee the accuracy or reliability of the content created by users. Statements, investment offers, product information, revenue information, user counts or similar commercial claims of users on the platform should not be assumed to be verified by FoundrOne.

Users are themselves responsible for the transactions and communications they carry out with each other. This clause cannot be interpreted in a way that eliminates the responsibilities imposed on FoundrOne by law.

22. Modification of the Service

FoundrOne may

  • add new features,
  • modify existing features,
  • remove features,
  • change its technical infrastructure.

Users may be informed appropriately in case of significant changes.

23. Service Interruptions

The platform may become temporarily inaccessible due to technical maintenance, security problems, infrastructure failures, third-party service interruptions or force majeure. FoundrOne does not guarantee that the service will always run without interruption or errors.

24. Third-Party Services

While the platform is running, third-party services such as MongoDB Atlas, Cloudflare, Cloudflare R2, Resend and Google may be used. The own terms of use and privacy conditions of these services may apply separately.

25. Personal Data

The principles regarding the processing of personal data are explained in the KVKK Privacy Notice and the Privacy Policy.

26. Modification of the Agreement

FoundrOne may update this Agreement when it deems necessary. The new version is valid from the date it is published. Reasonable notification is made for changes that significantly affect the rights of users.

27. Governing Law

Turkish law shall apply to the enforcement of this Agreement.

28. Disputes

In disputes, consumer legislation and other mandatory provisions are reserved. The competent and authorized courts are determined according to the Turkish legislation applicable to the concrete dispute.
